Look, you can't do a roadside sobriety test on someone in a coma. She did not have the right of way. Her state of awareness was at least equally relevant. If she had marijuana in her system, that is a fact, and reported as such. If Steve Benjamin had had marijuana in his system and that fact weren't reported, that would be seriously wrong. She wasn't "labeled a pothead"--the accurate facts of her blood tests were revealed.

Thank you for the article. I was shocked that the CPD states that she should have seen the car. That says alot about what kind of police dept. we have. The officers on the case supposedly had years of traffic accident experience. Sickening. And yes, Ms. Fenner, she had the right-of-way because you can turn right on red when nothing is coming. If she had night vision goggles, maybe then could she have seen a black car with NO headlights in the dark. BTW, "reasonable" rate of speed, I bet is more than the 35mph speed limit. If I ever get pulled, I will use the "Benjamin Reasonable Rate" excuse.

All the folks placing full responsibility for this accident on Mr Benjamin seem to ignore the fact that we have street lighting in downtown Columbia.

Bottom line, Benjamin got a pass from the media through out the entire investigation. Why wasn't Benjamin tested at the scene for alcohol consumption? I guess we'll never know. And of course we'll never hear Ms. Ruben's perspective on what actually happened! I agree with "Sparkle Clark's" opinion. From now on, I will use the "Officer, I was going at a Benjamin Reasonable Rate" excuse the next time I get pulled over!
